The UK Border Agency assigns Tier 2 Licensed Employers a rating based on their compliance with Tier 2 rules and processes. ‘A-Rated’ License Holders have no evidence of abuse and comply with all necessary Tier 2 systems, ‘B-Rated’ License Holders have been found to lack adequate systems to maintain compliance.
If you are an employer and you are planning on applying for a Tier 2 License it is very important that you put in place and maintain adequate systems to ensure compliance with Tier 2 rules and procedures. If at audit time the UKBA find inadequate systems or signs of abuse your license may be revoked and you may be fined.
Do you need to become Tier 2 Licensed to sponsor a skilled worker? If so Commonwealth Contractors may be able to assist not only with the license application but also with HR compliance. To find out more call now on 0800 294 4388 or Submit your Details and we will get right back to you!
The Scoring System
When assessing compliance the UK Border Agency use a simple 1-2-3 scoring system. The scoring system is applied to a sponsor’s human resources systems, civil penalties and criminal convictions issued to your staff and any non compliance by your organisation. Under the system a grade of:
- 1 means that you meet all of the criteria
- 2 means that you meet only some of the criteria
- 3 means that you do not meet any of the criteria
The UKBA will give an ‘A-Rating’ if the organisation receives a score or 1 in all three categories. If an organisation is given a 2 in any category the license holder will be given a ‘B-Rating’ and an action plan to get up to the required level.
