Croatia a Member of the EU from 1st July 2013

The Republic of Croatia became a member of the EU on the 1st July. This means that Croation nationals can now move and live freely in any member state of the EU. Member states may restrict access to the labour market for a transitional period and the UK is taking up the option to do so.

Before a Croation national can start work they may need to apply for worker authorisation also known as purple registration certificate or the purple card. Those qualifying for the purple card will generally be skilled workers who meet the criteria for the issue of a certificate of sponsorship under Tier 2 and Tier 5 of the points based system unless they are going to be employed as a postgraduate doctor/dentist, sole representative of an overseas business, or a domestic servant in a private household.

The complete Sponsor guidance is available here.

Highly Skilled Persons
A Croatian national may apply for a registration certificate confirming the holder
has free access to the labour market (a “blue registration certificate”) on the basis
that they are a highly skilled person. In order to be regarded as highly skilled, the Croatian national will have to either:

  • meet the relevant requirements of the exceptional talent category under
  • Tier 1 of the points-based system by obtaining an endorsement (e.g. a
    letter of recommendation) from a designated competent body. These
    bodies will either be The Royal Society, The Royal Academy of
    Engineering, The British Academy or the Arts Council; or

  •  in the period of 12 months preceding the date of their application for a
  • blue registration certificate, been awarded one of the following from a UK
    higher education institution:

  1. A recognised bachelor, masters or doctoral degree, or
  2.  A Higher National Diploma (HND) by a Scottish higher education
    institution.

Tier 2 Visa Sponsorship for Contractors

Do you have a contract offer and require Tier 2 Visa Sponsorship, but the client can’t or does not want to sponsor you?  Our Partners may be able to help if:

  • The daily rate is >£250.00 + vat
  • The client is prepared to give a deliverables-based (and not an agency worker based) contract
  • The role is not one that can be readily filled by an EU resident

UK Sponsorship visa solutions can be particularly relevant if you already have a contract you are performing on a temporary visa such as Tier 1 post study work visa, Tier 5 Youth Mobility (working holiday) visa, or even a Tier 4 Student visa. There are a limited number of companies that will give Tier 2 visa sponsorship.

If you have not yet secured a contract offer, don’t worry.  Often it can be difficult to even see a company until they know your visa will not be their responsibility.

We can also help with advice on marketing yourself so that you get the offer that may unlock sponsorship, and so you talk to people who don’t just discard expat CVs.

These solutions work particularly well in the IT, Engineering and Finance spheres.  If you are in another sector, don’t worry, we can discuss your individual situation.

Benefits of IT Consulting on a Tier 2 General Visa

There are many benefits to IT Consulting on a Tier 2 General Visa, including;

VARIED ASSIGNMENTS

Tier 2 General is a relatively restrictive employer sponsored visa. Therefore if you secure sponsorship for an ‘in house’ role you may find that you are stuck in the same position for 5 years before securing ILR. For many progressive IT consultants this stagnation can be very depressing.Alternatively working for a Consultancy offers the chance to work on many varied client facing assignments where opportunities for development are plentiful. After 5 years you could have delivered 10 – 20 projects and command a salary far in advance of ‘in house’ rivals.

MARKET LEADING REMUNERATION

Project rates normally increase from assignment to assignment. A Consultant who starts off on a project rate of £300 per day may go on to deliver other assignments at £350, £450, £500+ per day etc.Personal remuneration normally increases in line with project billing value.

EXTENSIVE EXPENSE POLICY

Our Consultancy Partners have extensive expense policies which generally include;

  • Accommodation & Utilities
  • Flights Home
  • Travel Expenses
  • Subsistence Expenses
  • Visa Costs
  • Computer Supplies
  • Training Manuals & Textbooks
  • Postage & Stationary etc

LONG TERM TIER 2 WORK RIGHTS

Tier 2 General Visas are normally approved for an initial term of 3 years however they may be extended for a further 2 years where further projects are in the pipeline

The United Kingdom is fairly well stocked for highly skilled IT professionals however unofficial skill shortages do exist in certain technical skill and experience combinations. Where such high end shortages are present companies frequently turn to those from outside of the European Union to solve the problem, in which case a Tier 2 General Visa may be offered. Many of our Clients are in need of highly skilled & experienced;

  • Senior Business Analysts
  • Systems Consultants
  • Project Leaders
  • Senior Systems Analysts
  • Development Team Leaders
  • Senior Systems Developers
  • Systems Architects
  • Senior Software Engineers

IT Consulting – On Tier 1 General (HSMP)

Are you a highly skilled IT Consultant? Do you hold a Tier 1 General Visa? If so Commonwealth Contractors can maximise your contract earnings AND help you to qualify for a Tier 1 visa extension or ILR!

If you possess a Tier 1 General visa you’re in a very fortunate situation as now that the visa class has been cancelled the only other real option is a restrictive employer sponsored Tier 2 General Visa (formerly UK Work Permit).

Tier 1 General gives the holder a large degree of freedom however if you possess the visa and you would like to work as an IT Contractor you need to be careful to pick your steps carefully. If you go for the ‘quick wins’ and use a contracting vehicle that is to tax efficient you could find that you fail in your all important visa extension.

At Commonwealth Contractors we have developed a Contracting Solution specifically for highly skilled IT Consultants on Tier 1 General visas.

To discuss your situation with an experienced professional call Commonwealth Contractors now on 0800 294 4388 or Submit your Details and we will get right back to you!

Qualifying for Indefinite Leave

At the moment you can apply for Indefinite Leave to Remain (also known as Permanent Residence) if you spend at least 5 unbroken years in the UK on a Tier 1 General Visa (please note that a break is considered to be any more than 90 days in any one year).

At Commonwealth Contractors our IT Consultants benefit from;

  • Professionally represented Indefinite Leave to Remain Applications
  • Employment Letters & References to validate employment income
  • Up to date news regarding changes to the ILR system
  • Guidance on contracting solutions post ILR

Switching to Tier 2 General

If you’re unable to qualify for a Tier 1 extension don’t despair, as you may be able to ‘switch’ in country from Tier 1 General to Tier 2 General.

Each year many highly skilled IT Consultants find that they are unable to qualify for a Tier 1 extension, with reasons including;

Insufficient earnings during the qualification period
Insufficient funds to validate the maintenance requirement
Inability to prove earnings due to the payment structure used e.g. Contractor Limited Company or Offshore Payment Vehicle

At Commonwealth Contractors our Tier 2 licensed consultancy partners may be able to assign an unrestricted Certificate of Sponsorship and transfer you from Tier 1 General to Tier 2 General (formerly the old UK Work Permit scheme) where a project based assignment exists for a minimum £250 per day for a minimum 3 month period.

Transferring from Tier 4 to Tier 2 General

Although possible, transferring from a Tier 4 Student Visa to Tier 2 General (formerly UK Work Permit) is very difficult. Tier 2 General to ILR & Citizenship Route

After completing 5 full years in the UK on a Tier 2 General Visa you can apply for Indefinite Leave to Remain (ILR) so long as you have not spent any more than 90 days outside the country in any one year.

Holding Indefinite Leave to Remain (also known as Permanent Residence) means that you spent long enough in the UK for the country to be considered your permanent home, although not long enough for it to be considered your country of Citizenship.

ILR status will allow you to come and go from the UK freely and work in the country without requiring a temporary work visa. Please note however that if you are planning to leave the UK (after securing settlement) for an extended period (2+ years) you will lose your entitlement to the status and you will need to qualify all over again.

Are you a highly skilled IT, Engineering, or Financial Services Professional? Do you need a Tier 2 General visa for the UK? If so Commonwealth Contractors may be able to help! We partner with Tier 2 Licensed employers and consultancies who may be prepared, where required, to sponsor an individual under Tier 2 General.

Submitting an Application for Tier 2 General to ILR

To submit an application as a Tier 2 General or Business and Commercial Work Permit holder you will need to:

  • Provide a fully completed and up to date SET (O) application form – You can find application forms on the UK Border Agency website within the ‘settling in the UK’ section here
  • Include supporting documents with your application including;
    • Original Passports
    • Current Passport Sized Photos
    • Proof of qualify against the Knowledge of Language and Life in the UK requirement (KOL)
    • Proof that you have been paid at or above the minimum required level for your Tier 2 General role
    • Birth Certificates and Marriage Certificates (for dependents)

Tier 2 / Work Permit Salary Requirements

If you hold a Tier 2 General Visa (or old style Work Permit) you will need to prove that you have been paid at or above the appropriate rate for the job as set out in the Tier 2 Codes of Practice.

To do this you will need to provide:

  • A written confirmation from your employer(s) confirming that you have been paid at or above the required level, AND
  • Original stamped and signed payslips to confirm the gross and net monthly payments, AND
  • Original personal bank statements to prove that net sums have been paid to you

If you are unable to provide this information you may find that you visa application is rejected.

Knowledge of Language and Life in the UK

In order to apply for ILR you will need to:

Losing ILR Status

If you secure ILR and then decide to leave the UK for a period of 2+ years you will lose your entitlement for the status and you will need to apply for entry clearance (normally further to a Tier 2 General Visa) all over again.

You will be able to return to the UK so long as:

  • When you last left the UK you held ILR status, AND
  • You have been away for less than 2 years, AND
  • You are returning to the UK to live here permanently, AND
  • You were not given public funds to pay the costs of leaving the UK
