UK Domicile

Your Domicile may be thought of as the place you ultimately regard as home. It is distinct from nationality and residence and you may only have one Domicile at a time.

If you’re a British national you will not necessarily lose your UK Domicile just because you emigrate to another country. Similarly, if you’re a non UK national you do not necessarily gain UK Domicile simply by living in the UK, even for several decades!

Deciding Domicile is not always clear cut. If for example you have a burial plot in the UK, you could be deemed to be UK domiciled (and thus be subject to UK inheritance tax on your estate) even if you have not set foot in the UK for decades. If you are an expat in the UK, once you have been resident in the UK for 17 out of 20 years you are likely to be considered domiciled in the UK for inheritance tax purposes. Where this occurs, on death, your worldwide assets will be taxed in the UK for inheritance tax.

Domicile of Origin

When a child is born they normally gain Domicile of Origin from their father. Domicile of Origin does not necessarily have to relate to the country in which the child was actually born. If the child was born while the parents were on a business trip abroad but they normally reside in the UK the child would be considered UK Domiciled.

Domicile of Dependency

Domicile of Dependency is where your Domicile follows that of the person you are legally dependent upon. Where you do not have the legal capacity the change your own domicile (normally because of age) you will acquire a new Domicile in place of your Domicile of Origin if the person upon whom you are dependent acquires a new domicile..

Domicile of Choice

Once you reach the age of 16 you have the legal capacity to acquire a new domicile through your own choice. In order to do this you must leave your existing country, settle in another one and provide solid evidence to prove that you intend to live there permanently.
