Client Tier 2 Licensing & Sponsorship
At Commonwealth Contractors our OISC Registered Immigration Partners can guide you and your Client through the minefield that is Tier 2 Licensing.Since November 2008 & the Introduction of Tier 2 of the Points Based System (PBS) every employer that intends to ‘sponsor’ a migrant worker must first gain permission form the UK Border Agency. This permission is given in the form of a Tier 2 Sponsorship License. To gain a license an employer must demonstrate adequate internal processes & procedures are in place to ensure ongoing Tier 2 compliance.
Once licensed a sponsor must judge who is worthy of sponsorship, no official feedback is provided until an Immigration Compliance Audit (conducted by the UK Border Agency). The new system places full responsibility for the worker with the employer & includes provisions for financial penalties & criminal convictions in the event of poor processes or non compliance.

Outsourcing a Project
Where a Client requires a piece of work to be delivered for a limited period of time & the work is such that it can be turned into a project it may be possible to engage the services of a Consultancy. Where this happens the Supplier is fully responsible for the service provided and the migrant worker.At Commonwealth Contractors we partner with ‘A Rated’ Tier 2 Licensed Healthcare & IT Consultancies prepared to sponsor workers on Tier 2 Visas where required. These consultancies cover all employer related immigration costs (£2,500 per worker) & take full responsibility for all compliance issues surrounding the worker.
To agree a Managed Project the following must happen:
- The Project must be defined (project description, deliverables, time estimates etc)
- Service Contracts need to be agreed between the parties (Client, Vendor, Supplier)
- Consultant documents must be provided to the Supplier
- A Tier 2 Application must be prepared, submitted & approved
