This guide relates to Tier 2 General, formerly the Business & Commercial Work Permit Scheme. The General sub-category of Tier 2 is intended for those skilled workers with an offer of employment from a Tier 2 Licensed UK Employer. The job offer will be made once it has been established that it is not possible to fill the position with a settled worker.
In order to offer the job to a person from outside the UK the employer must conduct a resident labour market search (where the position is not listed on the shortage occupation list) & once satisfied that all requirements have been met issue a Certificate of Sponsorship to the individual.
The prospective employee then uses the Certificate of Sponsorship as part of an application for a Tier 2 (General) visa. Please note that a Certificate of Sponsorship does not guarantee a Tier 2 visa. The applicant must score at least 50 points for ‘Attributes’ & satisfy the English Language & Maintenance requirements.
